Accepting these terms
This agreement applies to every visitor and user of DTGuns, including individual buyers and sellers, businesses, and anyone accessing the service on another entity's behalf. In this document, “you” means that person or entity; “DTGuns,” “we,” and “us” mean the marketplace and its operators.
Accessing or using DTGuns means you agree to these terms and our Privacy Policy. If you do not agree, do not use the platform. If you use DTGuns for a company or other organization, you represent that you can bind it to this agreement.
Who may use DTGuns
You must be at least 18 years old and legally capable of entering this agreement. Where the law sets a higher age for an item or transaction, that higher age controls.
By using the marketplace, you confirm that you are not prohibited from purchasing, possessing, receiving, or selling firearms under 18 U.S.C. § 922(g) or any other applicable law. You must also verify the eligibility of the other party before completing a transaction.
What the platform does—and does not do
DTGuns provides online classified listings and communication tools. We do not own or inspect listed merchandise, take title to it, guarantee a user's identity, guarantee listing accuracy, hold firearm inventory, process firearm payments, or act as an FFL, buyer, seller, broker, or transferor.
Any purchase, sale, shipment, meeting, payment, or transfer is a direct arrangement between users. You decide whether to proceed and assume the risks associated with the item and the other party. DTGuns operates as an interactive computer service for purposes of 47 U.S.C. § 230.
Accounts and community conduct
Keep your registration information accurate, safeguard your login credentials, and notify us if you believe your account has been compromised. You are responsible for activity performed through your account.
- Communicate honestly and respectfully.
- Do not harass, threaten, impersonate, or expose another person's private information.
- Do not send spam, deceptive promotions, or irrelevant solicitations.
- Use public comments for listing questions and private messages for transaction details.
- Do not use DTGuns to plan unlawful conduct or evade a legal requirement.
Standards for listings
A listing must describe the actual item accurately. Include the correct make, model, caliber or gauge, condition, price, and location; use clear photographs you are authorized to publish; and disclose material defects, modifications, or restrictions.
Do not use a misleading title, rely only on stock photography, include unauthorized personal contact details, direct users to a deceptive payment page, duplicate listings to manipulate results, or misrepresent ownership, condition, availability, or price.
Prohibited items and activity
You may not offer, request, promote, or arrange:
- an item whose possession, sale, shipment, or transfer is unlawful;
- stolen property or property you are not authorized to sell;
- a firearm with an unlawfully removed, altered, or obscured serial number;
- unlawful explosives, destructive devices, or restricted accessories;
- a straw purchase, prohibited-person transaction, or effort to avoid a required background check;
- fraud, money laundering, payment abuse, or any other criminal activity.
This list is illustrative rather than exhaustive. An item may be prohibited because of its configuration, location, intended recipient, or manner of transfer even if it is lawful elsewhere.
Transfers, shipping, and regulated items
Buyers and sellers must determine whether a licensed dealer is required, arrange any required NICS background check, and obtain all permits or approvals. NFA-regulated items require the applicable federal process and approval, which may include an ATF Form 4. Never transfer an item before required approval is final.
Interstate firearm transfers, ammunition shipments, and all carrier arrangements must comply with governing law and the carrier's current rules. DTGuns does not select the FFL or carrier and does not supervise, approve, or guarantee a transfer.
Your content and intellectual property
You retain ownership of content you submit. You represent that you own it or have permission to use it and that it does not violate another person's privacy, publicity, copyright, trademark, or other rights. You give DTGuns the non-exclusive permission needed to host, reproduce, resize, display, and distribute that content for operating and promoting the platform.
We may remove material identified in a sufficiently detailed copyright complaint and may restrict repeat infringers. To report alleged infringement, identify the protected work, the disputed material, and your contact information through our contact page.
Automated access and platform integrity
Without prior written permission, you may not scrape, harvest, bulk-download, republish, or commercially reuse listings, images, user information, or other platform content. You also may not bypass CAPTCHAs, login restrictions, rate limits, robot controls, or security measures; probe the service for vulnerabilities; or generate traffic that unreasonably burdens the service.
We may rate-limit or block automated traffic. Authorized search engine crawling is governed by our published robots directives and does not grant permission to republish DTGuns content.
Moderation and account action
We may review, restrict, remove, or preserve content and may suspend or terminate access when we believe it is appropriate to enforce these terms, protect users or the service, respond to a legal request, investigate fraud or abuse, or reduce risk.
Action may be taken with or without advance notice. You may stop using DTGuns at any time. Ending access does not erase obligations or liabilities that arose earlier, and provisions that logically should survive termination will remain effective.
Disclaimers and limits on liability
DTGuns and its content are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim express and implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service, a listing, or another user will be accurate, secure, available, or suitable for you.
To the fullest extent permitted by law, DTGuns and its officers, employees, and affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or data; personal injury or property loss connected with another user; or any transaction arranged through the platform. Aggregate liability arising from these terms or your use of DTGuns will not exceed $100.
Indemnity
You agree to defend, indemnify, and hold harmless DTGuns and its officers, employees, and affiliates from claims, liabilities, damages, judgments, losses, and reasonable attorneys' fees arising from your content, listing, transaction, use of the platform, breach of these terms, violation of law, or infringement of another person's rights.
Texas law and dispute resolution
Texas law governs these terms without regard to conflict-of-law principles. Any dispute arising from these terms or the platform will be resolved through binding arbitration on an individual basis. You and DTGuns waive participation in class actions and class arbitration to the extent permitted by law.
Updates and general provisions
We may revise these terms by posting an updated version and changing the date above. Continued use after the revised terms take effect constitutes acceptance. If a provision is found invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect.
A failure to enforce a provision is not a waiver. These terms, together with policies expressly incorporated by reference, constitute the agreement between you and DTGuns regarding use of the platform.
